Terms of Service

Acceptance

By engaging Fieldwork Aerial for drone services, you agree to these terms. Project-specific contracts may add to or modify these terms — in case of conflict, the project contract controls.

Services

We provide aerial photography, multispectral imagery, mapping, and inspection services using FAA Part 107 certified pilots and licensed equipment, in compliance with all applicable federal, state, and local regulations.

Insurance

We carry $1,000,000 in aviation liability insurance. Certificate of Insurance available within 24 hours of signed scope. Coverage details and additional insureds can be added on request.

Pricing and payment

  • Quotes are valid for 30 days unless otherwise noted.
  • Net 30 payment terms standard for invoices over $1,000.
  • Recurring contracts (monthly/quarterly) billed in advance.
  • Rush jobs (<48hr turnaround) carry a 25% surcharge.

Cancellation

  • Free reschedule any time before scope sign-off.
  • After scope sign-off, cancellation within 48 hours of flight: 50% of contracted amount.
  • Weather cancellations are at our discretion based on safe-flight criteria — full reschedule, no fee.

Deliverables and IP

All raw data and processed deliverables created from your project are licensed to you for unrestricted use in your business operations and marketing. We retain the right to use anonymized examples in our portfolio unless explicitly excluded by NDA.

Limitations of liability

Our liability for any claim related to services is limited to the amount paid for those services. We do not warrant accuracy beyond stated tolerances (typically ±2-5% for drone-only volume measurements). For survey-of-record-grade work we recommend partnership with a licensed surveyor — discussed at scope.

Force majeure

Wildfires, evacuation orders, FAA TFRs, weather, and other events outside reasonable control are excused performance events. We'll communicate as soon as practical and reschedule.

Governing law

These terms are governed by California law. Venue for any disputes: Santa Clara County Superior Court, except as required by federal law for FAA-related matters.

Changes

We may update these terms with 30 days notice via email to active clients. Continued engagement after the effective date constitutes acceptance.
